24 February 2021 – SARS increases its focus on wealthy individuals and offshore holdings

You Need Posted on 24/02/2021 by vrapto24/02/2021
Tshwane, 24 February 2021 – The South African Revenue Service (SARS) is committed to its strategic intent to develop and administer a tax and customs system based on voluntary compliance. We believe that most taxpayers want to fulfil their legal obligations voluntarily. In this regard, SARS provides clarity and certainty to taxpayers to fulfil these obligations, and works diligently to make it easy and seamless to transact with the organisation. Equally important for SARS is to make it hard and costly for those taxpayers who do not comply.
For SARS to continue to provide a customized and seamless service to various categories of taxpayers, we are establishing a separate unit to focus on Individual Taxpayers with wealth and complex financial arrangements. The unit, which will be known as High Wealth Individual Taxpayer Segment (HWI) will initially be co-located with the Large Business & International Taxpayer Segment (LB&I).

This unit will focus on individual taxpayers with wealth and complex financial arrangements. We will be offering a differentiated service, as we do with other tax types, to the individuals with significant wealth, often derived from multiple sources other than a salary and who employ complex, and often offshore, financial arrangements. We believe that statements of assets and liabilities often say more about their financial affairs than statements of income.

SARS is on a journey to foster a culture of voluntary compliance. Consequently, we have been paying particular attention to taxpayers with undeclared offshore holdings to optimise compliance. As an early adopter of the international standard for the Automatic Exchange of Financial Account Information, SARS has at its disposal information relating to offshore account holdings of South African taxpayers, some which seems not to have been declared. The information that has come into our possession shows possible non-compliance by a number of these taxpayers.
In 2016/17, taxpayers were given the opportunity to regularise their tax affairs to account for their offshore holdings through the Special Voluntary Disclosure Programme (SVDP). Taxpayers also had the opportunity to do so through the ongoing Voluntary Disclosure Programme (VDP) under the Tax Administration Act, 2011. Some taxpayers took advantage of this. However, despite the window of opportunity to regularise their tax affairs, some taxpayers chose not to do so. The information that SARS has received comes from 87 jurisdictions across the world, detailing the offshore financial holdings of South African taxpayers. We intend to undertake a careful review of the information and audit it, where necessary.
In the interests of fair and efficient administration of the system, SARS will be writing to affected taxpayers to request information about their offshore holdings. The request is for relevant material for risk assessment purposes that does not signal the commencement of an audit process but may inform future action.
Taxpayers who want to regularise their tax affairs are still able to do so through the ongoing VDP, which offers more favourable terms for an assessment (in terms of penalty amount). SARS therefore encourages taxpayers with undisclosed assets to take advantage of the VDP process. Taxpayers are reminded that failure to do so may result in administrative or even criminal action being taken against them.
A dedicated email address, [email protected] has been set up to manage responses from affected taxpayers and adopt a consistent approach. Affected taxpayers who wish to make use of the ongoing VDP and taxpayers who have not yet been contacted are advised to contact the VDP Unit directly at [email protected].

8 February 2021 – Online filers have one week to meet deadline

You Need Posted on 08/02/2021 by vrapto08/02/2021

Pretoria, Monday 8 February 2021 – The South African Revenue Service (SARS) reminds taxpayers that the Filing Season deadline for provisional taxpayers ends on 15 February 2021.

SARS Commissioner Edward Kieswetter said taxpayers are encouraged to use eFiling or the SARS MobiApp, which is a convenient and safe online method to transact with SARS under the current circumstances.

He urged taxpayers who received auto-assessment notices last year but who have not yet either accepted the auto-assessments, or edited and filed a return in response to the notice, to make use of this opportunity to do so.

Commissioner Kieswetter also urged these taxpayers to comply with their legal obligations by 15 February 2021, as it is vital that all taxpayers remain compliant. Failure by provisional taxpayers and auto-assessment taxpayers to edit and file a return to comply by this date will result in administrative penalties being levied.

The Commissioner concluded by asserting that, “While SARS believes that most taxpayers and traders comply voluntarily and want to do the right thing, we also have measures we can use to enforce compliance. However, such enforcement always remains a last resort”.

4 February 2021 – SARS Customs make a massive rhino horn bust worth R53-million

You Need Posted on 04/02/2021 by vrapto04/02/2021

February 4, 2021, Pretoria – The Customs unit of the South African Revenue Service (SARS) made a bust of rhino horn with an estimated value of R53 172 000, in a shipment destined for Malaysia.

While conducting manifest profiling at the courier facilities, the Customs Detector Dog Unit at O.R.Tambo International Airport selected a suspicious shipment declared as ‘HP Cartridges Developers’.

The three-piece shipment was taken to the X-ray scanner for non-intrusive inspection, where the image analysis reflected objects resembling the shape of rhino horns.  The shipment was taken for physical inspection and upon inspection of the boxes, 18 pieces of rhino horn were found concealed in traditional clothing. The goods weighed 63kg.

This is the fourth rhino horn bust by SARS Customs at the O.R.Tambo International Airport between July 2020 and February 2021. The overall weight of the rhino horn seized in these four cases is 277.30 kg with an estimated value of R 234 114 206.

The Customs officers immediately called the Directorate of Priority Crimes Investigation (Hawks) to the scene who confiscated the shipment for further investigation.

In his reaction to this massive seizure of the rhino horn, Commissioner Edward Kieswetter congratulated the Customs officers for their excellent work.

He warned the perpetrators of crime that SARS, working with other law enforcement agencies, would spare no efforts in confronting and dealing decisively with any criminal malfeasance. Those that are involved in such egregious and merciless killing of rhinoceros and mutilating them will be brought to book.

He furthermore said, “Those that are determined to destroy the rich natural endowment of our country, which is a common treasure and heritage for all, that we should look after for future generations, will be met with unwavering commitment of our officers to enforce the law.”

28 January 2021 – SARS extends Filing Season Provisional Taxpayer deadline for online filers

You Need Posted on 28/01/2021 by vrapto28/01/2021

Pretoria, Thursday 28 January 2021 – The South African Revenue Service (SARS) has noted with deep concern the unprecedented health challenge manifested through COVID-19 with the accompanying loss of lives and livelihoods. SARS wishes to convey its sincere and deepest condolences to those that have lost their loved ones and wish a speedy recovery to those who are convalescing at home or in hospital.

In light of these challenges, SARS has taken a decision to extend the Filing Season deadline for provisional taxpayers, which is currently set for 29 January 2021, to 15 February 2021.

In line with SARS’ communication on steps taken to prevent the spread of COVID19 and protect both the taxpayers and SARS staff, taxpayers are encouraged to use eFiling or the SARS MobiApp.

SARS Commissioner Edward Kieswetter said, “The decision to extend the Filing Season,  was taken with due consideration of the traumatic effects being experienced by taxpayers who have lost loved ones, as well as businesses who have lost staff, during the devastating second wave of Covid-19.

The Commissioner also urges taxpayers who received auto-assessment notices last year but who have not yet accepted the auto-assessments, or edited and filed a return in response to the notice, to make use of this opportunity to do so.

The Commissioner urged all these taxpayers to comply with their legal obligations by 15 February 2021, as it is vital that all taxpayers remain compliant. Failure to comply with their legal obligations will result in administrative penalties being levied.

He added that SARS has a legislative mandate to collect revenue due and to ensure compliance across all segments of taxpayers, as well as traders in the Customs arena.

“While SARS believes that most taxpayers and traders comply voluntarily and want to do the right thing, we also have measures we can use to enforce compliance. However, such enforcement always remains a last resort,” the Commissioner added.
